Items 1 & 2 » - Item 1 Discussion regarding Ashley Ward Economic Development Agreement One of the holders of an economic development grant, Ashley Ward, has not met its employment goals for tax year 2012. Under its agreement and the Board’s current written policy, Ashley Ward was required to maintain at least 10 new jobs. For 2012, Ashley Ward only employed 7 people. The jobs requirement is in Article 5 of the agreement which is attached. The grant was originally given in 2006. Ashley Ward has received 6 out of the maximum of 10 payments. The County has the option to terminate the development agreement. It also has the option to skip the payment for tax year 2012 and reinstate next year if Ashley Ward is able to hire more people to meet the 10 job threshold. The recommendation of the Committee is requested. Item 2 Discussion regarding Clay County Economic Development Grant for Alternate Energy Technologies, LLC (AET) The 2012 tax year would have been the first year of eligibility for the local economic development grant given to AET by the Board of County Commissioners. At the time the grant was awarded, the contract called for 10 new jobs paying at least 101% over the Clay County Average wage. At the time AET entered into the grant, the company brought 47 existing jobs to Green Cove and intended to create at least 10 “new” jobs. The project was scored based on 10 new jobs. In order to receive a grant, a project must create at least 10 jobs. This year, AET did not create 10 new jobs. AET did bring 47 existing jobs to Clay County, Florida. The question in this case is: Does the Board of County Commissioners wish to clarify the Agreement to allow for the 47 existing jobs to satisfy the jobs requirement of the economic development policy? The jobs are new to Clay County although not newly created. There is precedent in the County for allowing a grant when less than the minimum policy number of jobs is created but the employer brings several existing jobs into the County as well. The Blue Cross Blue Shield economic development grant was approved with 25 existing jobs which transferred and 10 new jobs created at a time when the policy was a minimum of 100 jobs created. The sole difference with AET is that no new jobs were created. The action of the committee is requested.
